External Attorney and Workplace Investigator

Dwayne Smith is an external attorney investigator who works with employers, general counsel and EPLI carriers to deliver independent, case assessments that address employee-related concerns—including harassment, discrimination, retaliation, and professional misconduct.

As Founder of Workplace Law Solutions, I’m engaged when neutrality, and credibility are paramount—to advise, and address employee related concerns with confidence.

My background is equal parts law, compliance, and operations. I served as Director of Compliance for Liberty Public Schools, designated for Title VI, Title VII, Title IX, Section 504, and ADA matters, and I have conducted 100+ investigations.

I’m licensed in Missouri and Kansas and hold AWI‑CH (Association of Workplace Investigators) and SHRM‑SCP credentials.

I teach Advanced School Law as an Adjunct Professor at Saint Louis University, bringing a practical, teachable approach to educational workplace concerns.

How I help employers, law firms & carriers:

  • Independent investigations with clear scope, trauma‑informed interviews, and concise reports aligned to policy and law.
  • Case assessments and early risk evaluations to help counsel and carriers determine exposure and strategy before litigation escalates.
  • Expert Witness – review of workplace investigation reports and workplace investigation practices.
  • Employee Relations – Including Policy & handbook reviews that reduce exposure and support consistent outcomes—topics I present on regularly include, Conducting Workplace Investigations, Employee Handbooks, and Employee Relations.

NIL Contract Negotiation

I advise on Name, Image, and Likeness (NIL) matters, supporting financial planners and collegiate student‑athletes with contract review, negotiation strategy, and compliance alignment. My focus is practical and risk‑aware: structuring agreements in coordination with licensed professionals, and avoid downstream conflicts with team, school, or collective obligations.

NIL support includes:

  • Deal review & negotiation for sponsorships, appearances, camps/clinics, social media/ and licensing arrangements.
  • Conflict & overlap checks (team/school policies, collective terms, exclusivity, non‑disparagement, morals clauses).
  • Advisor alignment with financial planners, CPAs, and (where applicable) athlete agents—keeping roles clear and preserving privilege where possible.

Dr. Dwayne E. Smith served as the Director of Compliance with Liberty Public Schools from 2018-2023.  Dwayne was the district’s designee for Civil Rights (Title VI, VII, IX), Section 504, and ADA to ensure compliance with federal and state law and school board policy.

His work in Liberty Public School includes conducting over 100 investigations regarding claims of Discrimination, Harassment, Retaliation, Staff Conduct, Staff-Student Relations, and Professional Conduct. Dwayne counseled, advised and trained  Administrators and Staff regarding claims of Harassment, Discrimination, Retaliation, Staff Conduct/Professionalism, Confidentiality, Social Media Impacts, and Bullying (Student-Student).

Dwayne spent ten years as a high school administrator in the North Kansas City School District, and eighteen years in the private sector at Sprint in Product Management and Contract Negotiations. Dwayne is an Attorney (Licensed in Missouri and Kansas) and former Jackson County Assistant Prosecuting Attorney. 

Dwayne earned his B.S. degree from Kansas State University,  his J.D. and M.A. in education administration from the University of Missouri Kansas City, and his Ed.D. in Education Leadership from Saint Louis University. He is an adjunct professor at Saint Louis University, School of Education, teaching Advanced School Law.

Dwayne is a member of the Association of Workplace Investigators (AWI) and holds a Senior Professional certification SHRM-SCP from the Society of Human Resources Management.

Dwayne has been a board member of Blue Valley Industries, a nonprofit adult workshop since 2003.
